  1. SCOPE

This Personal Data Protection Policy shall apply to all Databases and/or Files containing Personal Data that are subject to Processing by Mva Cleaning and Maintenance LLLC , each individually considered to be responsible and/or in charge of the processing of Personal Data, (hereinafter THE COMPANY).

  1. DEFINITIONS

Authorization: Prior, express and informed consent of the Owner to carry out the Processing of Personal Data. · Privacy Notice: Verbal or written communication generated by the responsible party, addressed to the Owner for the Processing of their Personal Data, through which they are informed about the existence of the Information Processing Policies that will be applicable to them, the way to access them and the purposes of the Processing that is intended to be given to the personal data. · Database: Organized set of Personal Data that is subject to Processing. · Personal Data: Any information linked to or that can be associated with one or more specific or determinable natural persons. · Data Processor: Natural or legal person, public or private, that by itself or in association with others, carries out the Processing of Personal Data on behalf of the Data Controller. In the event that the Responsible Party does not act as the Person in Charge of the Database, the Person in Charge will be expressly identified. · Data Controller: Natural or legal person, public or private, who by himself or in association with others, decides on the Database and/or the Processing of the data. · Terms and Conditions: general framework in which the conditions for participants of promotional or related activities are established. · Owner: Natural person whose Personal Data is subject to Processing. · Processing: Any operation or set of operations on Personal Data, such as collection, storage, use, circulation or deletion. · Transfer: Data transfer takes place when the controller and/or Processor of personal data, located in Colombia, sends the information or personal data to a recipient, who in turn is a Controller and is located inside or outside the country. · Transmission: Processing of Personal Data that involves the communication of the same within or outside the territory of the Republic of Colombia when it is intended to carry out a Processing by the Processor on behalf of the responsible party.

  1. TREATMENT

Mva Cleaning and Maintenance LLLC, acting in its capacity as Data Controller of Personal Data, for the proper development of its commercial activities, as well as for the strengthening of its relationships with third parties, collects, stores, uses, circulates and deletes Personal Data corresponding to natural persons with whom it has or has had a relationship, such as, without the enumeration implying limitation,  workers and their families, shareholders, consumers, customers, distributors, suppliers, creditors and debtors.

  1. PURPOSE

Personal Data is processed by Mva Cleaning and Maintenance LLLC for the following purposes: 5.1. To send information to their workers and families; 5.2. For the provision of health services to the relatives of THE COMPANY workers who are beneficiaries of the health service; 5.3. For the recognition, protection and exercise of the rights of the shareholders of Mva Cleaning and Maintenance LLLC; 5.4. To strengthen relationships with its customers, by sending relevant information, taking information required for the formalization of the service to be provided, whether in leases or sales, and attending to Requests, Complaints and Claims (PQR’s) by the customer service and Quality area, evaluating the quality of its customer service and inviting them to events organized or sponsored by Mva Cleaning and Quality. Maintenance LLLC, among others; 5.5. For interaction with its Distributors, for verification of compliance with distribution standards, of its legal obligations to its workers and for the invitation to events organized or sponsored by Mva Cleaning and Maintenance LLLC, among others. 5.6. To consolidate a timely and quality supply with its Suppliers, through the invitation to participate in selection processes, the evaluation of compliance with its obligations and the invitation to events organized or sponsored by Mva Cleaning and Maintenance LLLC, among others; 5.7. For the verification of the balances of its creditors; 5.8. For the determination of outstanding obligations, the consultation of financial information and credit history and the report to information centers of unfulfilled obligations, with respect to its debtors; 5.09. For marketing, statistical, research, and other commercial purposes that do not contravene applicable laws in the United States of America; 5.10. To attend to judicial or administrative requirements and compliance with judicial or legal mandates; 5.11. To eventually contact, via e-mail, or by any other means, natural persons with whom it has or has had a relationship, such as, but not limited to, its employees and family members, shareholders, consumers, customers, distributors, suppliers, creditors and debtors, for the purposes mentioned above.

  1. RIGHTS OF THE OWNERS OF PERSONAL DATA

Natural persons whose Personal Data are subject to Processing by Mva Cleaning and Maintenance LLLC, have the following rights, which they can exercise at any time: 6.1. To know the Personal Data on which Mva Cleaning and Maintenance LLLC is carrying out the Processing. Similarly, the Owner may request at any time that their data be updated or rectified, for example, if they find that their data are partial, inaccurate, incomplete, fragmented, misleading, or those whose Processing is expressly prohibited or has not been authorized. 6.2. Request proof of the authorization granted to THE COMPANY for the Processing of your Personal Data. 6.3. To be informed by Mva Cleaning and Maintenance LLLC, upon request, regarding the use that it has given to your Personal Data. 6.4. Submit complaints to the Superintendence of Industry and Commerce for violations of the provisions of the Personal Data Protection Law. 6.5. Request THE COMPANY to delete your Personal Data and/or revoke the authorization granted for the Processing of the same, by filing a complaint, in accordance with the procedures established in numeral 11 of this Policy. However, the request for deletion of the information and the revocation of the authorization will not proceed when the Owner of the information has a legal or contractual duty to remain in the Database and/or Files, nor while the relationship between the Owner and Mva Cleaning and Maintenance LLLC, by virtue of which their data was collected, is in force. 6.6. Access your Personal Data subject to Processing free of charge.

  1. AREA RESPONSIBLE FOR THE IMPLEMENTATION AND OBSERVANCE OF THIS POLICY

The General Management of Mva Cleaning and Maintenance LLLC is in charge of the development, implementation, training and enforcement of this Policy. For this purpose, all officials who carry out the Processing of Personal Data in the different areas of THE COMPANY, are obliged to report these Databases to the customer service area and to immediately transfer to it all requests, complaints or claims they receive from the Owners of Personal Data. The General Directorate has also been designated by Mva Cleaning and Maintenance LLLC as the area responsible for dealing with requests, queries, complaints and claims before which the Owner of the information may exercise their rights to know, update, rectify and delete the data and revoke the authorization.

  1. AUTHORIZATION

Mva Cleaning and Maintenance LLLC must request prior, express and informed authorization from the Owners of the Personal Data on which it requires to carry out the Processing. 8.1. Prior authorization means that consent must be given by the Owner, no later than the time of collection of the Personal Data. 8.2. Express authorisation means that the Owner’s consent must be explicit and specific, open and non-specific authorisations are not valid. The Owner is required to express his/her willingness to authorize Mva Cleaning and Maintenance LLLC to carry out the Processing of his/her Personal Data. This expression of the Owner’s will can occur through different mechanisms made available by Mva Cleaning and Maintenance LLLC, such as: · In writing, filling out an authorization form. · Orally, for example, in a telephone conversation or in a videoconference. · Through unequivocal conduct that allows it to be concluded that it granted its authorization, for example, through its express acceptance of the Terms and Conditions of an activity within which the authorization of the participants is required for the Processing of their Personal Data. IMPORTANT: In no case will Mva Cleaning and Maintenance LLLC assimilate the silence of the Owner to unequivocal conduct. Informed Authorization means that, at the time of requesting consent from the Owner, the Owner must be clearly informed: · The Personal Data that will be collected. · The identification and contact details of the controller and the Data Processor. · The specific purposes of the Processing that is intended to be carried out, that is: how and for what purpose the collection, use, and circulation of Personal Data will be carried out. · What are the rights you have as a Personal Data Owner; for this purpose, see paragraph 6 of this Policy. · The optional nature of the answer to the questions asked, when they deal with sensitive data or the data of children and adolescents.

  1. SPECIAL PROVISIONS FOR THE PROCESSING OF PERSONAL DATA OF A SENSITIVE NATURE

According to the Personal Data Protection Law, data of a sensitive nature are considered to be those that affect privacy or whose improper use may generate discrimination, such as those related to: · Racial or ethnic origin. · Political orientation. · Religious/philosophical convictions. · Membership of trade unions, social organisations, human rights organisations or political parties. · Bless you. · Sex life. · Biometric data (such as fingerprint, signature, and photo). The Processing of Personal Data of a sensitive nature is prohibited by law, unless there is express, prior and informed authorization from the Owner, among other exceptions. In this case, in addition to complying with the requirements established for authorisation, Mva Cleaning and Maintenance LLLC shall: · Inform the Owner that because it is sensitive data, it is not obliged to authorize its Processing. · Inform the Owner which of the data that will be subject to Processing are sensitive and the purpose of the Processing. IMPORTANT: No activity may be conditioned on the Owner providing sensitive Personal Data.

  1. PROCEDURE FOR ATTENDING TO AND RESPONDING TO REQUESTS, QUERIES, COMPLAINTS AND CLAIMS FROM THE OWNERS OF PERSONAL DATA

The Owners of the Personal Data that are being collected, stored, used, put into circulation by Mva Cleaning and Maintenance LLLC, may exercise at any time their rights to know, update, rectify and delete information and revoke the authorization. For this purpose, the following procedure will be followed, in accordance with the Personal Data Protection Law: 10.1. ATTENTION AND RESPONSE TO PETITIONS, COMPLAINTS AND CLAIMS What does the procedure consist of? Attention and response by THE COMPANY: Requests and queries will be attended to within a maximum term of fifteen (15) business days from the date of receipt of the same. When it is not possible to respond to the request or query within said term, the interested party will be informed, stating the reasons for the delay and indicating the date on which their request or query will be addressed, which in no case may exceed eight (8) business days following the expiration of the first term.

  1. INFORMATION OBTAINED PASSIVELY

When you access or use the services contained within Mva Cleaning and Maintenance LLLC’s websites, it may passively collect information through information management technologies, such as “cookies”, through which information is collected about the hardware and software of the equipment, IP address,  browser type, operating system, domain name, access time, and the addresses of the referring websites; through the use of these tools, no Personal Data of users is directly collected. Mva Cleaning and Maintenance LLLC does not guarantee the total security of your information nor is it responsible for any consequences derived from technical failures or improper entry by third parties to the Database or File in which the Personal Data subject to Processing by Mva Cleaning and Maintenance LLLC and its Processors  are based.Mva Cleaning and Maintenance LLLC will require the service providers it hires to adopt and comply with the appropriate technical, human and administrative measures for the protection of Personal Data in relation to which said providers act as Processors.

  1. TRANSFER, TRANSMISSION AND DISCLOSURE OF PERSONAL DATA

Mva Cleaning and Maintenance LLLC may disclose to its related companies worldwide, the Personal Data on which it carries out the Processing, for its use and Processing in accordance with this Personal Data Protection Policy. Likewise, Mva Cleaning and Maintenance LLLC may deliver Personal Data to third parties not related to Mva Cleaning and Maintenance LLLC when: a. They are contractors in execution of contracts for the development of the activities of Mva Cleaning and Maintenance LLLC; b. This Personal Data Protection Policy, the Privacy Notice and the Authorization Form that is part of this Policy are governed by the provisions of the current legislation on the protection of Personal Data referred to in the Political Constitution of the United States of America and other regulations that modify them.  repeal or replace.
